Barnett, in writing Jacob’s clemency petition sought a letter in favor of release from his sentencing Judge. In replying back, the Honorable Henry Coke Morgan, Jr. recalled his sentencing comments (Barnett, 248). When you think about the discretion that Judges have in doing their jobs within Federal Criminal Justice, when bound by the rules of then MANDATORY Sentencing guidelines, the Judges are stripped of their powers as judges to do what they think is just. Following the decision in United States v. Booker, the Sentencing Guidelines are now advisory rather than mandatory. Do you think Congress went in the correct direction in making the sentencing guidelines advisory? Why or why not? Explain your position.
2. This course by name is about Corrections. Therefore one would assume the the goal of prison and incarceration is to correct the individuals placed in said facilities? Right? Or Wrong?where have we gone wrong in the overall scheme of correcting individuals especially when stat remains true that 2/3 of individuals re-offend within 3 years after release from state or federal custody? If “correction” was working, then this stat wouldn’t still be true.
